Mediation provides a chance for the parties to reach a consensus regarding the resolution of their case. Arbitration presents an opportunity for parties to settle a case in which the value may not be mutually agreed upon, but a more effective and economical resolution than a trial may be accessible.
Honorable Emil Giordano (Ret.) has spent more than 30 years in court on both sides of the bench. He served on the Northampton County Court of Common Pleas for 15 years, handling every type of civil case. In 2018, he stepped down from the bench in order to practice law once again, focusing on arbitration, mediation, wills, and estates.
Giordano is an accomplished mediator. He has been certified by the Harvard Law Mediation Program. He has tried or heard thousands of cases dealing with issues ranging from family law and personal injury to medical malpractice, labor, and zoning matters. He represented both injured plaintiffs and defendants’ insurers through trials and settlements during his practice from 1985-2003, where he also represented both organized labor as well as management. Additionally, he has served as a Municipal Solicitor and represented private landowners.
Unlike some mediators/arbitrators, he is an active litigator. He comprehends the elements and peculiarities of a case and the stakes presented to both sides of any jury trial. It is true that some cases must be tried; however, trying these cases is necessary due to the miscalculation of one of the sides (and occasionally both of them). Not only are jury verdicts unpredictable, but trying a case is expensive, inefficient, and does not provide finality, since one side always has the option of appealing.
Giordano commits himself to your case alone: he does not permit any distractions to interfere with his ability to pay you his undivided attention. Additionally, he offers his services statewide.
He mediates and arbitrates primarily in the following areas: personal injury, medical malpractice, trusts, estates law, public policy issues, zoning, labor, family law, and community development. Additional practice areas include animal law, contract law, defamation law, employment law, insurance law, labor and union law, product liability law, property law, real estate law, and riparian rights.
